The following document describes the general terms and conditions to access and use dek.live website and platform, referred below as to Platform, the Platform, Network, the Network, Website or the Website, in accordance, among other regulations. with the REGULATION (EU) 2023/1804 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 13 September 2023 on the deployment of alternative fuels infrastructure, and repealing Directive 2014/94/EU, as defined in Document 32023R1804.
Vendor or host –eCars BG EOOD or any partner of eCars BG EOOD, designated in writing by eCars BG EOOD as a Vendor, whose services are offered through the Website dek.live.
dek.live – The Website, Platform or Network through which the Vendor provides Users with the opportunity to receive digital information via electronic device such as mobile phone or computer and internet connection about the available locations and charging stations for electric vehicles on the geographical territory of Bulgaria and other countries, and the opportunity to start and pay for charging of electric vehicles at some of these charging stations listed on the Website as content, by utilizing different payment methods, ad hoc or using an optional registration and profile account on the Website, which registration allows for additional options or enhanced services.
Website, Platform or Network– dek.live and its sub-domains or folders.
Document – the current text, titled TERMS AND CONDITIONS OF USE, outlining terms and conditions for access and usage of the Website. The text as a whole is written by and property of the Vendor and related only to the Website and services related to the Website.
Operator – means the entity that is responsible for themanagement and operation of a location(s) and/or charging station(s) and that provides an access to charging services to end users, including in the name and on behalf of a mobility service provider.
Mobility service provider – means a legal entity that provides services related to remote access and use of charging stations for electric vehicles in return for remuneration to an end user, including the selling of charging services;
Dashboard – means an administrative management interface panel located at specific web address provided by the Vendor to Operator, to manage and maintain information, operational data, transactions and history of usage of charging stations and charging points.
Data user - means any public authority, road authority, road operator, charging stations operator, research or non-governmental organisation, mobility service provider, e-roaming platform, digital map provider or any other entity interested in using data to provide information, create services or perform research or analysis on alternative fuels infrastructure;
e-roaming - means the exchange of data and payments between the operator of a charging station and a mobility service provider from which an end user purchases a recharging or refuelling service;
e-roaming platform - means a platform connecting market actors, notably mobility service providers and operators of electric vehicles charging, to enable the provision of services between them, including e-roaming;
Dynamic data - means data that change often or on a regular basis;
Static data - means data that do not change often or on a regular basis;
Server – means a computer or computer program which manages access to a centralized resource or service in a network;
Operated by the Server – means charging stations connected via internet connection to the Server, for which charging stations the Vendor may show actual operating status on the electronic geographical map on the Website, and provide Services to the User.
User or end user – means a natural or legal person that uses the Website in any way including for purchasing a Service (see definition of Service below).
Registered User – means User, who voluntarily registered an account with a Profile on the Website.
Profile – A section of the Website, dedicated specifically to a Registered User, to which the Vendor provides the Registered User access to, optionally and not mandatory. The User is provided an option to create a profile by entering an email address and password in a registration form on the Website, known only to the User. This process is defined as Registration. After successful registration on the Website, the User can access the section of the Website for registered users by entering the email and password used for the registration, to login into the section.
The section may contain data related to User’s Website usage, including, but not limited to, data about transactions and paymentsfor the Service (see definition of Service below), history of some of User’sactions on the Website,such as history of charging sessions (see definition of Charging session below), receipts,invoices, etc., with all such data visible only to the User and not other users of the Website.
Balance – means a digital wallet containing an amount of funds deposited by a User in the User’s Profile on the Website, using a bank card, through which balance the User can make payments for the Service through the Website.
Login – means a digital procedure of entering the Profile through a dedicated form with specific fields, available to the User after voluntary registration on the Website.
Logout – means a digital procedure of exiting the Profile by pressing a software button in the menu of the Profile, available to the User after voluntary registration on the Website and after successful login into the Profile;
Menu – a list of commands in the form of hyperlinks, available to the User after Login to the Profile;
Voucher – means a physical or digital coupon containing an equivalent of an amount of funds provided to the User after purchasing (or by other means) from the Venfor or from a third party voucher provider including, but not limited to charging stations operators and mobility service providers. deposited by a User in the User’s profile on the Website, using a bank card, through which balance the User can make payments for Services through the Website.
Bank card – means a physical debit or credit card issued by a bank, with which the User can pay for the Service.
RFID – means a physical plastic card with embedded electronics that can be utulized by the User as a method of identification to authorize a recharging service;
e-RFID – means a term developed and defined by the Vendor, representing an electronic version of RFID in the form of a digital number, that can be utilized by the User as a method of identification to authorize a recharging service;
Ad hoc basis – means a way of using the Service without preliminary planning and without any upfront obligations by the User;
Ad hoc price - means the price charged by the operator of a recharging station to an end user for recharging on an ad hoc basis;
Electric vehicle– means a motor vehicle equipped with a powertrain containing at least one non-peripheral electric machine as energy converter with an electric rechargeable energy storage system, which can be recharged externally;
Plug-in hybrid vehicle– means an electric vehicle with a conventional combustion engine combined with an electric propulsion system which can be recharged from an external electric power source;
Socket – means the physical interface (in the form of hardware receptacle attached to a charging station) between the recharging station and the vehicle through which the electric energy is exchanged;
Connector or plug – means the physical interface (in the form of hardware plug attached to an electric cable) between the recharging station and the vehicle through which the electric energy is exchanged;
Charging cable – means an electric cable attached to a charging station, or an electric cable with two connectors, used to make a wired connection between a charging station and electric vehicle;
Charging on an ad hoc basis - means a charging service purchased by an end user without the need for that end user to register, conclude a written agreement or enter into a commercial relationship with the Operator of that recharging point that goes beyond the mere purchase of the recharging service;
AC – means Alternate Current
DC – means Direct Current
Charging station - means a physical installationat a specific location,
consisting of fixed or mobile, on-grid or off-grid device with AC or DC interface
for the transfer of electricity to an electric vehicle.;
Charging station station dedicated to light-duty vehicles - means a charging station intended for the charging of light-duty vehicles, due to the specific design of the connectors/plugs or the design of the parking space adjacent to the recharging point, station or pool, or both;
Charging station dedicated to heavy-duty vehicles - means a charging station intended for the charging of heavy-duty vehicles, either due to the specific design of the connectors/plugs or to the design of the parking space adjacent to the recharging point, station or pool, or both;
Normal power charging station - means a recharging point with a power output less than or equal to 22 kW for the transfer of electricity to an electric vehicle;
High-power charging stations - means a recharging point with a power output of more than 22 kW for the transfer of electricity to an electric vehicle;
Digitally-connected charging station - means a recharging point that can send and receive information in real time, communicate bi-directionally with the electricity grid and the electric vehicle, and that can be remotely monitored and controlled, including in order to start and stop the recharging session and to measure electricity flows;
CCS 2.0 – means an abbreviation of Combined Charging System, which represents a specific protocol for electrical connection and set of interface procedures and rules between Direct Current charging station and an electric vehicle, mainly, but not only, available in the European market;
CHAdeMO – means an abbreviation of Combined Charging System, which represents a specific protocol for electrical connection and set of interface procedures and rules between Direct Current charging station and an electric vehicle, mainly, but not only, available in the Asian market;
Type1 – means a specific protocol for single phase electrical connection and interface between Alternate Current charging station and an electric vehicle, mainly, but not only, available in the Asian market;
Type2 – means a specific protocol for single phase and three phase electrical connection and interface between Alternate Current charging station and an electric vehicle, mainly, but not only, available in the European market;
Charging protocol – means a set or an array of predefined rules, parameters, software packages and other technical elements used to define specific methods of interface, communication, data exchange and flow of electric energy between charging stations and electric vehicles.
Proprietary charging protocol – means a charging protocol developed and produced by specific charge stations manufacturers
OCPP – means an abbreviation of Open Charge Point Protocol
Power output - means the theoretical maximum power, expressed in kW (kilowatt), that a charging station can provide to vehicles connected to that charging station;
Quick Response code (QR code) - means an ISO/IEC 18004:2015-compliant encoding and visualisation of data;
Button – means a combination of small graphical image and text on the Website, which when pressed by a finger on a touchscreen or mouse on a computer, initiates the processing of specific function, related to the Service or other function on the Website;
Icon – means a small image on the Website, indicating specific function, type of object, type of information, type of service or other means of providing additional guidance;
Pin – means an icon of specific type, situated on a geographical map on the Website, showing the location of a charging station on the map;
Cluster – means an image icon of specific type, situated on a geographical map on the Website, showing the location of a group of charging stations or charging points within specific area of the geographical map on the Website.
Filter – means a set of software widgets on the Website, representing different parameters, that can by utilized by the User to conduct specific search of information or data related to charging stations and services available on the Website.
Direction – A tool accessible by pressing a dedicated button on the website, providing geolocation service and guidance through the digital map functions to assist travel to a physical charging point location;
Location – A specific geographical place where charging station is located;
Payment service - means a ‘payment service’ as defined in Article
4, point (3), of Directive (EU) 2015/2366 of the European Parliament and of the
Council (29);
Payment processor– means a third party legal entity, licensed to provide access to a payment Gateway and related payment transaction services to the Vendor and the User;
VPOS – means an abbreviation from a Virtual Point of Sale, which is an electronic service that allows the Vendor to process payments without a credit card reader, mobile application, or special hardware. VPOS electronic service is provided to the Vendor by a Payment processor
Tariff – means a monetary amount for using the Service;
Fiscal Receipt – a fiscal electronic slip containing information for transaction and payment for a charging service;
Invoice – a fiscal document containing information for transaction and payment for a charging service;
Service or Services – means remote access to the Website by the User via internet connection and electronic device such as smartphone or computer, that allows the User to receive services such as, but not limited to: remote access to information on the Website; remote access to real time data of the operating status of charging stations visible on the Website; availability for a User to voluntarily create a Profile on the Website, availability for a User to make electronic payments to start a charging session of electric vehicle charging along with physically connecting the electric vehicle to a publicly accessible charging station that is software operated via the Website, and any related services on the Website.
Authorization – means a process of User identification at a charging station, in order to grant the User access to the Services.
Charging session– means the process of recharging the battery of an electric vehicle with electricity by properly physically connecting the electric vehicle to a charging station by the User. After properly physically connecting the electric vehicle to the charging station and starting the process by the User using a selected charging start method, the process begins exactly from the moment the flow of electricity has started from the charging station to the electric vehicle. The actual, numerically defined, start of the charging session is the first timestamp that the server sets for the process after receiving the Start Transaction command. The actual, numerically defined, end of the charging session is the final timestamp that the server sets for the process after receiving the Stop Transaction command. The final duration of the charging session is defined as the time duration between the start timestamp and the end timestamp;
Smart charging – means a recharging operation in which the intensity of electricity delivered to the battery of an electric vehicle through charging station is adjusted in real-time, based on information received through electronic communication between charging station, the electric vehicle and the power grid;
Definitions of content:
– All theinformation on the Website that is accessible through an Internet connection and using a device connected to the Internet;
– The content of each message from the Website to the User, sent by electronic means and/or any other available means of communication;
– Any information provided by the Website to the User in any way by electronic or other means of distance transmission;
– Information related to the Services and/or applicable tariffs from the Website, including from third parties publishing information on the Website in a certain period of time;
– Information about Users and related to the Services and/or applicable tariffs from third parties with whom the Vendorhas entered intopartnership agreements in some form;
– Data about the Vendoror other data relating to it.
The General Terms and Conditionsof the Vendor, described in this document, titled TERMS AND CONDITIONS OF USE,are binding on all users of the Website.
Any use of theWebsite means that the User (a) has carefully read these TERMS AND CONDITIONS OF USEfor the access and usage of the Websiteand (b) has agreed to comply with these TERMS AND CONDITIONS OF USEunconditionally.
The TERMS AND CONDITIONS OF USE may be changed unilaterally by the Vendor at any time, by updating them. These changes shall enter into force immediately after published on the Website and shall be binding toall users/clients.
Vendorhas the right to make changes to the TERMS AND CONDITIONS OF USE at any time at its own discretion or if they are imposed by virtue of a valid regulatory act. Any changesmade to the TERMS AND CONDITIONS OF USE may have retroactive effect with respect to services already delivered.
In any case of a change to the TERMS AND CONDITIONS OF USE,the Vendor will inform the Users by publishing the changes on the Website. In this sense, the User has the obligation to check for any changes to the TERMS AND CONDITIONS OF USEof the Website each timethe User enters the Website.
If any of the provisions of these TERMS AND CONDITIONS OF USE of the Website prove to be invalid or unenforceable, regardless of the reason for this, this shall not entail the invalidity or enforceability of the remaining provisions.
The Vendor makes continuous efforts to maintain the accuracy of the information presented on the Website. However, taking into account possible technical errors or omissions in this information, as well as changes in the information independent of the Vendor,or provided by third parties outside of the ability of the Vendor to check the accuracy of, the Vendor specifies that the information is indicative in nature, may differ from the current one and the Vendor is not responsible for inconsistencies and inaccuracies in the information provided.
The characteristicsor tarriffsof the services described on the Website are non-binding forthe Vendorand may accordingly be corrected at any time. The Vendor cannot be held liable for damages resulting from any obvious technical errors that have occurred or been made on the Website.
It is possible that, due to limited space and the consistent structure of the information, the descriptions of the services may sometimes be incomplete. However, the Vendorwill alwaysstrive to provide the most relevant,accurate and important information.
The Website may contain hyperlinks to other websites. The Vendoris not responsible for the privacy policies of websites that are not administered by the Vendor, as well as for other information contained therein.
The content, as defined in the CONTENTchapter, including the logos of the Vendor and the Website,or inscriptions, trade marks, dynamic symbols and texts on the Website, related to the Vendor and the Website are the exclusive property of the Vendor. The content, inscriptions, trade marks, dynamic symbols and texts related to any third parties described on the website, may be property of the respective third parties. The Vendor is not claiming any property over such content and cannot be held liable for providing such content to the Users on the Website.
The Vendor has and reserves all intellectual property rights related in any way to the Website, whether they are its own or obtained through contractual licenses or in any other lawful manner.
Nothing in the distance contract concluded between the Vendor andthe Usershall be deemed as permission by the Vendor tothe Userto copy, distribute, publish, provide to third parties, modify in any way any part of the Content, including but not limited to the content of the trademarks, logos, multimedia content of the Website or descriptions of the Services in any way, including by introducing any content external to the Website, removing the signs indicating the ownership right of Vendorto the Content. The Useris also not entitled to transfer, selland/or distribute materials created by reproducing (copying), modifying or publishing the CONTENT, except with the express written consent of the Vendor.
Any CONTENT on the Websiteto which the Userhas access, regardless of the means thereof, is subject to regulation by these TERMS AND CONDITIONS OF USE.
The Userdoes not have the right to use the CONTENTfor commercial purposes. Any suchuse of the CONTENTis and will be considered a breach of these TERMS AND CONDITIONS OF USE representing anagreement between the Vendorand the Userand a breach of the intellectual property rights of the Vendor,whohas the right to hold the Userliable for such violations of TERMS AND CONDITIONS OF USE.
Simply sending to the Useror referencing the CONTENTor parts thereof by the Vendor will not be considered as consent by the Vendorto allow the Userto use the CONTENTor parts thereof for its own purposes other than its personal needs, as defined by the TERMS AND CONDITIONS OF USE regardless of the means of communication used by the Vendor.
Any use of the CONTENTfor purposes other than those expressly permitted in these TERMS AND CONDITIONS OF USEor in other express written consent given by the Vendoris prohibited.
The User agrees that by providing voluntarily and not mandatorily any of his/her personal or other data to the Vendor, they may be used by the Vendorfor any lawful purposes, without the Vendorneeding to seek and obtain the User's consent to process them in each individual case.
The User agrees to provide the Vendorwith unlimited access in volume and time to any dataand information that the Usersends to the Vendorthrough or in connection with the Website, regardless of whether the Userhas placed an Order and completed a transaction through the Website. The Vendor has the right to use, reproduce, publish, modify, transmit and distribute this information or data. The Userexpressly agrees that the Vendormay freely use and process for its own purposes the ideas, concepts or know-how that the Userhas provided to the Vendorin any way through or in connection with the Website or the actions/inactions that the Userhas taken through or in connection with the Website.
The Vendorhas no obligation to keep the information thus obtained confidential, to the extent that this is not imposed on the Vendoras an obligation by the applicable legislation.
By voluntarily providing their data to the Vendor(including an e-mail address), the User expressly consents to being contacted by the Vendoror third parties who are partners of the Vendor and are providers of marketing services, state, municipal or non-governmental agencies or companies in the insurance sector, when this is provided for by the specific legislation, as well as other companies with which the Vendormay develop joint programs for offering the Services on the market, etc.
The User is responsible for maintaining the confidentiality of his/her password and login details in the Profile and is fully responsible for all actions taken through the Profile. The Provider recommends that users who use the Website through the Profile using the Login/Logout function, perform the Logout function after the end of each session of using the Profile by clicking on the Logout button in the Profile menu.
Services general definitions
The Vendor provides the Users, Operators or Mobility service providers with an ability to use the Website for, but not limited to, the following services:
User
- To access the Website via internet connection and electronic device such as mobile phone, tablet, desktop computer or laptop, without providing personal data to the Vendor;
Operator
- To access the Website and administrators’s panel of the Website via internet connection and electronic device such as mobile phone, tablet, desktop computer or laptop, without providing personal data to the Vendor, to add charging stations and charging points to the geographical map of the Website, by entering into agreement with the Vendor and providing data and information about the charging stations to the Vendor, who is responsible for adding the data to the Website. This allows the Operator to provide the User the ability to access and use Operator’s charging points and charging stations for the Services, through the Website;
Mobility service provider
- To enter into e-roaming partnerships with the Vendor in order to provide Services on the Website;
Services details for the User
The User is provided the opportunity to use the following services by the Vendor, on the Website:
- To remotely access the Website via internet connection and electronic device such as mobile phone, tablet, desktop computer or laptop, without providing personal data to the Vendor, or by voluntarily and not mandatory providing specific personal data to the Vendor;
- To obtain information about charging stations for electric vehicles, operators of charging stations and mobility service providers, published on the Website;
- To search for charging stations for electric vehicles on the geographical map of the Website;
- To select Pin of a charging station on the geographical map of the Website, select charging connector, select charging amount, pay by bank card in a Payment Processor interface and start a recharging session for filling the battery of an electric vehicle with electricity, without providing personal information to the Vendor;
- To scan a QR code on the charging station screen or label with the camera of a mobile phone, to use the above functionality instead of selecting a Pin on the geographical map on the Website. After scanning the QR code the User is provided with a hyperlink, which directs the User to the charging station page on the Website, where User can select charging connector, select charging amount, pay by bank card in a Payment Processor interface and start a recharging session for filling the battery of an electric vehicle with electricity, without providing personal information to the Vendor;
- To voluntarily register a Profile on the Website, by creating an account with email and password credentials;
- To maintain the Profile on the Website;
- To delete the Profile on the Website;
- To use a Balance of the Profile as a means of digital wallet for storing funds and paying for the Services;
- To store e-RFID numbers in the Profile or in the mobile phone browser via
cookies, to use e-RFID as an identification method to authorize recharging
session start;
- To use Direction tool on a charging station information window, by selecting
the Direction button, that provides travel guidance on a geographical map, to
arrive at a charging station;
- To use Voucher provided by the Vendor or Vendor partner, to authorize the start
of a recharging session;
- To receive fiscal documents issued by the Vendor or any authorized partner of
the Vendor, for the use of Services;
Servicesfor remoteaccess, payments, start and stop of charging session on charging stations via the Website dek.livecan be used only on charging stations connected via a communication protocol to the dek.livesoftware platform via the Website dek.liveunder an agreement with respective charging station operators. Some explicitly marked charging stations on the Website may be used without authorization and without payment, while others may require authorization and/or payment.
This functionality is available only to voluntarily registered Users at the Website. For the purpose of using additional features and options of the Website, Users can register an account and create a Profile at the Website. The method to identify a voluntarily registered User at the Website is called Login. The Website identifies the User by saving cookies to the browser of the User’s electronic device. Cookies can be stored and deleted by the User.
To use the Services and remotely start a charging session at charging stations located on the geographical map of the Website, the following methods of authorization are available to the User:
- Bank card
- RFID card
- e-RFID number
Payments for the Services through the Website can be utilized by:
(a) a bank card via the VPOS terminal on the Website;
(b) the User's Balance, to which the User can add funds through the User’s Profile on the Website.
Payments processing methods for the Services on the Website.
- Charging stations operated by dek.live platform software:
Payments are processed by the Vendor’s VPOS, provided to the Vendor by licensed payment processor company.
- Charging stations operated by other operators via e-roaming, listed on the Website, but not operated by dek.live platform software:
Payments are processed by respective payment methods of the operators of the charging stations operated by operators connected to Website dek.live, but using their own payment processing methods. The Vendor is not responsible by any means for providing information about such methods or about the utilizing of such methods by the respective third parties or Operators;
Types of payment cards accepted: debit, credit and business cards Visa and Mastercard;
Transactions are carried out using the security programs MasterCard Identity check and VISA Secure;
From a security point of view, the maximum amount for payment by card is 150.00 BGN;
The voluntary registration on the Website allows the User to store limited data or information about bank cards in the User’s Profile and to add funds to the Balance. The actual process of storing a bank card is carried out by the Payment Processor on a dedicated web form of the Payment Processor, and the Vendor displays only the limited data or information about the bank card in the User’s Profile, that the Payment Processor is providing to the Vendor. This allows User to use the Balance as a payment method instead of paying for the Services directly by bank card and entering the bank card details for every charging session. Only the Payment Processor stores the whole data or information about the User’s bank card.
Beforestarting a chargingsession through the Website, the User selects the payment method to be used, if payment is required, then selects amonetary amount of choice using an interactive amount selection bar, where the minimum amount is 2 BGN, proceeds to choose payment method, and pays. By confirming the payment, the User accepts and agrees that theUser’s bank card will be debited bythe monetary amount selected by the User for the charging service via the selection bar, including applicable taxes and service fees, and that after a successful payment the charging service is initiated upon successful communication between the charging station and the electric vehicle. This payment is called pre-authorization, that constitutes a process to reserve the monetary amount selected by the User via the selection bar from the User’s bank card available funds, which process is carried out by the Payment Processor.
The final amount for the charging service, which is based on the relevant tariff specified on the Website or at a charging station known to the User before the charging service is started, will be calculated after the charging sessionis completed and will be debited immediately from the User’s bank card. For User’s convenience, during the charging session process on the Website or on the charging station display, where available, intermediate information on the duration, the charged electricity and the current tariff, is displayed. Any unused amount of the initial monetary amount selected by the User via the selection bar, is refunded to User’s bank card after the charging session end, and after actual transaction payment processing by the Payment Processor. The refund time depends on the processing bank(s). If the charging session does not start successfully, the reserved monetary amount that User selected via the selection bar is released and available in the User’s bank card.
The currenttariffs for the Services that the Vendor provides to the User on charging stations software operated by the Server, are clearly displayed on the Website, therefore the Vendor considers thatthe User is informed about the tariffsof the Services.
It is the User’s responsbility to always check tariffs before starting a charging session on charging stations located on the geographical map of theWebsite and operated by the Server. The Vendor and Operatorsreserve the right to periodically change the tariffs. All changes are promptly reflected on the Website aapply immediately after their update on the Website.
The tariffs shown on the chargings stations located on the geographical map of the Website, software operated by the Server,are determined by the respective Operators,and not by the Vendor, except on charging stations owned by the Vendor, and include VAT.
The Vendormay issue an invoice upon request from the User for the Services paid by the User through the Website.
To receive an invoice for services paid through the Website, the Registered User must enter invoice data in accordance with the current legislation in the Billing & Invoices section in the User’s Profile before processing charging sessionson the Website.
To receive an invoice for services paid through the Website, anon-Registered User must send company data in accordance with the current legislation and also the charging session number by email to the Vendor at support@dek.live, after completing a charging session.
In order for the Vendor to properly compile invoices, it is the User's responsibility to provide up-to-date company data in his profile on the Website.
The Vendorissues invoices for Services paid by the User through the Website, only for Services provided at charging stations operated by the Server.
In case certainamount paid by bank card should be refunded, the said amount can only is refunded to the bank card with which the payment was made.
The Vendoris not liable for any damages suffered by the User or third parties as a result of force majeure circumstances or circumstances that are beyond the control of the Vendor, such as, but not limited to, lack of internet connection to a charging station, inaccessible charging station, malfunctioned charging station, damaged charging station, loss of connection to the Server and others.
In all other cases, the liability of the Vendoris limited to the monetaryamount of the disputed Service paid by the User through the Website.
In accordance with the requirements of Convention 108 for the protection of individuals with regard to the automated processing of personal data and the Personal Data Protection Act in the Republic of Bulgaria, the Vendoris obliged to process personal data under conditions that guarantee their storage and prevent their accidental loss and only for the specified purposes.
By voluntarily filling in the data in theRegistration and Profile form, the User declares and unconditionally accepts that his personal data will be included in the database of the Vendorand gives his/herexplicit and unambiguous consent to all such data being archived, used and processed without territorial and/or time limitation by the Vendor, its partners and associates for activities such as, but not limited to, commercial activities, for product and service promotions, marketing, advertising, for media, administrative and research purposes, autorities lawful data requests, as well as for market research and for monitoring user activity. Also, the User gives his/herexplicit and unambiguous consent to the processing of such data by the Vendorand to transfer it to partners of the Vendorand other third parties in Bulgaria and other countries.
Each User is deemed to be informed of these general terms and conditions, according to which the User's rights provided for in the processing of personal data, as well as the right to change his personal data, are guaranteed.
The User agrees and authorizes the Vendorto provide his/her personal data to other companies with which the Vendoris in partnerships, but only if the Vendorhave undertaken to store and process such datain accordance with regulatory requirements. Such companies are: marketing service providers, couriers providing payment/banking services, telemarketing or other services provided by companies with which the Vendorcan develop joint programs for offering on the market the Goods and Services offered bythe Vendor orthe Vendor’s partners.
The User's personal data may be provided to the prosecutor's office, the police, judicial institutions or other state authorities, on the basis and within the framework of lawfulprovisions and following an explicit request from them to do so.
All disputes relating to these General Terms and Conditions that the parties have not been able to resolve through negotiations and mutual agreement shall be referred to the competent court in the territory of the city of Sofia. The Vendor advises its users to regularly check the Website in order to familiarize themselves with the latest current version of these General Terms and Conditions.
Neither party shall be liable for the failure to fulfill its contractual obligations if such failure is due to force majeure. A force majeure is an unforeseeable event, beyond the control of the parties, which cannot be avoided.
If within 14 (fourteen) days from the date of the relevant event, it does not stop, each party has the right to notify the other party that it is terminating the Agreement, without owing the other any compensation for any damages that may have been suffered.
